1. Acceptance of terms
By creating an account or using Fielded (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of service
Fielded provides an AI-powered SMS assistant that helps trade businesses manage customer enquiries, collect job details, and schedule appointments. The Service uses third-party infrastructure including Twilio for SMS delivery and OpenAI for AI responses.
3. Account responsibilities
You are responsible for maintaining the security of your account credentials. You must ensure that the business information you provide is accurate and up to date. You may not share your account with others or use it to send unsolicited messages.
4. Acceptable use
You agree to use Fielded only for lawful business communications with customers who have legitimately contacted your business. You must not use the Service to send spam, harass individuals, or violate any applicable laws including the Spam Act 2003 (Australia).
5. SMS and customer data
By using Fielded, you acknowledge that SMS conversations between your customers and the AI agent are stored and processed on our servers. You are responsible for ensuring you have appropriate consent from your customers to communicate via SMS.
6. Billing and trials
New accounts include a free trial period. After the trial, continued use requires a paid subscription. We reserve the right to change pricing with reasonable notice. You may cancel at any time; cancellations take effect at the end of the current billing period.
7. Limitation of liability
Fielded is provided “as is”. We do not guarantee that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
8. AI-generated responses
Responses sent to your customers are generated by an AI and may occasionally be inaccurate. You remain responsible for reviewing conversations and ensuring your customers receive correct information. Fielded is not liable for any loss arising from AI-generated content.
9. Termination
We may suspend or terminate your account if you violate these terms or use the Service in a way that could cause harm to other users or third parties. You may close your account at any time by contacting us.
10. Changes to these terms
We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
